Most disputes can – and should – be resolved by
the parties before a resolution is imposed by a third party –
whether it be a judge or an arbitrator. Ms. Welch’s philosophy
as a mediator is based on the understanding that most disputes
should and do settle prior to trial – and there is usually a way to
accomplish a settlement using a skilled neutral. Often the
process requires intense negotiation, sometimes facilitation – but
always the attention, intense preparation, and time commitment on
the part of the mediator, before, during and after the mediation
session. Ms. Welch brings her extensive experience in the law
and in business to seek pragmatic solutions to disputes.
Arbitration by design should be easier, faster,
and more economical for the parties. But an arbitrator should
also have excellent legal training, and ideally, business experience
to understand the core issues in dispute.
Ms. Welch’s extensive business and legal
experience has prepared her well to provide sophisticated,
knowledgeable services as an arbitrator. She has served as an
arbitrator in an extensive range of securities, commercial, intellectual
property, and employment disputes. She is a member of the California State Bar's Committee on Alternative Dispute Resolution.
